1. Definitions

Throughout these Terms and Conditions, the following terms apply:

• "eclaireess", "we", "us", "our" — refers to eclaireess, operating from 111 Somerset Road, #04-09, TripleOne Somerset, Singapore 238164.
• "Client", "you", "your" — refers to any person who uses our services, makes an enquiry, or enters into a service agreement with us.
• "Service" — refers to any car hire, chauffeured drive, or concierge arrangement offered by eclaireess, including but not limited to the Personal Shopper's Drive, Fortnightly Subscription Hire, and Proposal Experience Package.
• "Agreement" — the binding arrangement formed when a booking is confirmed by eclaireess in writing (including by email).
• "Website" — the eclaireess website accessible at eclaireess.live.

2. Acceptance of Terms

By using our website, submitting an enquiry, or confirming a booking, you agree to these Terms and Conditions in full. If you do not agree, please discontinue use of the website and do not proceed with a booking.

You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. For self-drive services, you additionally confirm that you hold a valid driving licence recognised in Singapore.

3. Service Description

eclaireess offers three primary service arrangements:

• Personal Shopper's Drive (SGD 520): A chauffeured hire of up to 6 hours for retail and errand purposes within Singapore. The service includes a driver, vehicle, and in-car refreshments as described in the service listing.
• Fortnightly Subscription Hire (SGD 2,650): A 14-day self-drive vehicle hire including delivery and collection at a nominated Singapore address, roadside assistance, and one mid-period vehicle swap. The hire covers a generous mileage allowance as outlined at the time of booking.
• Proposal Experience Package (SGD 780): A chauffeured hire of up to 4 hours with vehicle preparation (florals, refreshments, playlist) and concierge coordination for a marriage proposal arrangement. Post-event transfer is included.

Services are available in Singapore only. We reserve the right to refuse or modify a booking where the requested itinerary or conditions fall outside our standard operating scope, and will communicate this promptly.

4. Booking and Payment

• Bookings are confirmed only upon receipt of written confirmation from eclaireess.
• Payment is due at the time of confirmation unless otherwise agreed in writing.
• We accept payment by bank transfer and major credit or debit cards via our secure payment processor.
• Prices are quoted in Singapore Dollars (SGD) and include applicable goods and services tax (GST) where required.
• eclaireess reserves the right to adjust pricing for future bookings with reasonable prior notice.

5. Cancellation and Amendments

• Cancellation more than 48 hours before service start: Full refund of amounts paid, less a SGD 30 administrative charge.
• Cancellation between 24 and 48 hours before service start: 50% of the service fee will be retained.
• Cancellation within 24 hours of service start: No refund will be issued.
• Amendments: Requests to change date, time, or service scope must be made at least 24 hours in advance and are subject to vehicle and driver availability. We will do our best to accommodate changes.
• For the Proposal Experience Package, requests to modify vehicle preparation (florals, refreshments) must be made at least 48 hours before the service date to allow suppliers to be notified.

Cancellation requests must be submitted in writing by email to [email protected]. Verbal cancellations will not be accepted.

6. Client Responsibilities

• Provide accurate information when making a booking, including pick-up address, timing, and any specific requirements.
• For self-drive services, present a valid driving licence at the time of vehicle handover. Failure to do so will void the booking without refund.
• Use the vehicle for lawful purposes only. Vehicles must not be used to transport illegal goods, exceed passenger capacity, or be driven outside Singapore without prior written approval.
• Return the vehicle in the same condition as received (normal wear excepted). Damage, soiling requiring specialist cleaning, or loss of vehicle accessories will be charged at cost.
• Adhere to all Singapore traffic laws, LTA regulations, and road rules while driving our vehicles.
• Smoking is not permitted in any eclaireess vehicle. A cleaning charge of SGD 150 applies if this condition is violated.

7. Self-Drive Hire — Additional Terms

• The client named on the booking is the primary authorised driver. Additional drivers must be declared in advance and are subject to our approval and an additional documentation check.
• All vehicles are insured under a comprehensive policy for authorised drivers. Unauthorised drivers are not covered under any insurance policy.
• The mileage allowance applicable to a Fortnightly Subscription is agreed at the time of booking. Excess mileage is charged at SGD 0.25 per kilometre.
• The mid-period vehicle swap is available once per Fortnightly Subscription booking. Swaps are subject to fleet availability and must be requested at least 48 hours in advance.
• Vehicles are delivered with a full fuel tank. The client is responsible for returning the vehicle with an equivalent fuel level; a refuelling charge of SGD 80 plus the cost of fuel applies otherwise.

8. Intellectual Property

All content on the eclaireess website — including text, design elements, images, and service descriptions — is owned by or licensed to eclaireess. You may not reproduce, distribute, or adapt any content without our prior written permission. Access to the website does not grant any intellectual property rights.

9. Disclaimers

Our services are provided in good faith and with reasonable care. We do not, however, make representations or warranties regarding:

• Specific outcomes of a proposal arranged through our Proposal Experience Package — results are not within our control and depend on personal circumstances.
• Traffic or road conditions in Singapore, which may affect journey timing.
• Vehicle model or colour — we reserve the right to substitute a vehicle of equivalent category and standard where necessary.

10. Limitation of Liability

To the extent permitted by Singapore law, eclaireess's total liability for any claim arising from a service booking shall not exceed the amount paid by the client for that specific booking.

We shall not be liable for indirect, incidental, or consequential losses, including but not limited to missed appointments, lost revenue, or emotional distress, except where such liability cannot be excluded under applicable law.

Nothing in these terms excludes or limits liability for death or personal injury resulting from our negligence, or for fraud or misrepresentation.

11. Force Majeure

eclaireess shall not be in breach of its obligations where performance is prevented or delayed by circumstances outside our reasonable control, including severe weather, road closures, civil emergencies, government directives, or vehicle breakdown due to unforeseen mechanical failure. In such circumstances, we will notify you as promptly as possible and offer a rescheduling or full refund at your election.

12. Privacy

Your personal data is handled in accordance with our Privacy Policy, which forms part of the overall terms governing your engagement with eclaireess. By using our services, you confirm that you have read and understood the Privacy Policy.

13. Termination of Service

eclaireess reserves the right to terminate or suspend a booking or service arrangement without notice where:

• A client provides false or materially misleading information in connection with a booking.
• A client's conduct during the service is threatening, abusive, or unlawful.
• A self-drive vehicle is used in a manner that violates these terms or applicable law.

In such cases, no refund will be issued for the unused portion of the service.

14. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of the Republic of Singapore. Any dispute arising from or connected to these terms shall first be referred to good-faith negotiation between the parties.

If a dispute cannot be resolved informally within 30 days, either party may submit it to the Singapore Mediation Centre, or where applicable, the Small Claims Tribunals of Singapore. Courts of Singapore shall have exclusive jurisdiction over matters that proceed to litigation.

15. General Provisions

• Entire Agreement: These terms, together with any confirmed booking documentation and our Privacy Policy, constitute the entire agreement between the parties.
• Severability: If any provision is found unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that right in future instances.
• Assignment: You may not assign your rights under a booking to another party without eclaireess's prior written consent.

16. Changes to These Terms

We may update these terms from time to time. Updates will be published on this page with a revised effective date. Bookings made prior to a revision are governed by the version of these terms in effect at the time of confirmation.
